Federal Judge Clears Way for 9/11 Ground Zero / WTC Lawsuits
In a huge victory for Ground Zero workers, federal judge Alvin Hellerstein issued a 99 page ruling yesterday giving these heroes the opportunity to sue the City of New York, private contractors and the Port Authority of New York and New Jersey for their 9/11 related illnesses.
In the last few months, after the passage of the new 9/11 workers' compensation law, our workers' compensation attorneys have been deluged with calls from Ground Zero workers with various illness's they believe are related to exposure to toxins at Ground Zero. In addition to new workers' comp claims, they may now also be entitled to have an additional lawsuit against the City of New York for failing to warn them of the dangerous and sometimes deadly conditions at the former World Trade Center site. Great news to here of these recent 9/11 W/C decisions. I worked directly at the scene from day one as a unpaid professional providing basic
and advanced life support PRN. As a result of my servie to my community I have sustained permanent injuries one of which will lead to shorter life span. I'm no stranger to in the line of duty injuries having been a Rikers Island Corrections Officer. I have a major beef with the system,,when I was beening treated for one of my injuries in 2005.I was talking to many for FDNY and PD members,,they were talking about how much monies they received through the Victims Compensation Board,,for example one guy got 250,00 dollars.
Why is it that we the volunteer Firemen and Paramedics were not informed that we could have put a claim in? Not one Vol. Fireman or Medic heard that they could have!
@ of the guys received alot of money,,and to top it off they were stupid enough to laugh about the fact that they both had asthma before going on the job. In Closing when I was paid by the City to possibly be hurt or killed, it was an accepted belief that such
potential for injuries and or death is just what it is . A part of the jobs. when I was slashed by a inmate did I consider my self a victim? Hell, No! Part of the job,straight and simple. WE who place our lives in harms way while others sleep in the night and while doing said, without and pay! Noble virtues.
Why were we thrown aside,,while paid workers wether PD, FD, or highly paid union construction workers,,oooh think of the overtime at unionrates, incredible,,,,me I'd rather help people for less than half the pay.
It is clear the Government should apologize
to all unpaid professional/Volunteer Firemen/EMS. And that they should let us submit claims through the NYS Victims Compensation Board. Myself I don't have the luxury of unlimited sick or injury leave as I did so while working for the DCNY, I lost 2 jobs because of my injuries and have had to borrow money from family,,hard thing to do.
Meanwhile I treat illegal immigrants who receive good care and it costs US Billions,,but has or will the State or Federal Gov's offered monetary relief or accurate medical monitoring. I'm a multi-licensed Health Care Practitioner, in various aspects of Medicine. I know the differences in the system and care. I went to the Mt. Sinai study
and was aghast at the level of lack of concern for accurate studies. Thank God I had a proper
pulmonary study and brought the results,,they are deaf or they missed the class on lung sounds and for the pulmonary study with no known base line for my lungs existed prior to 9/11, I had to blow into what ammount to a digital hand held incentive spirometer,,I brought my radiographs of my lung prior to 9/11 and after,,they shit thenselves. when I read their report,it was as though they totally disavowed a pulmonary study provided by one of NY's best Hospital's and X-Rays to boot.
Sorry for the rant I've been laying awake at night way to much,,to much,,
